What should a job placement contract include?
A job placement contract for a fee arranges employment for a job seeker with a third party. The right to provide job placement services is granted to a legal entity or an individual, provided they meet all the conditions established by law. In the employment mediation contract, you should find the following details:
- Identification details of the mediator (name, address, identification number)
- Duration of the employment relationship
- Type of work and working conditions
- Salary conditions
- Method and conditions of health and social insurance
- Scope of the mediator's responsibility for non-compliance with the agreement terms
In case you are planning to work abroad, the intermediary is obliged to inform you about your rights and obligations related to working abroad.
Can the agency charge me a fee for mediation?
No, it cannot. The intermediary can only charge a fee to the person for whom the employee is being mediated. The intermediary also agrees with this person on the amount of the fee. According to the law, a personnel agency must not charge job applicants fees for mediation. Some other services, such as arranging transportation or accommodation, may be chargeable. Always study the contract thoroughly and if something is unclear to you, ask questions.
If an agency issues a mediation contract that does not comply with the Employment Services Act, it is possible to file a complaint for investigation with the Central Office of Labour, Social Affairs and Family. If the agency's illegal practices are proven, the investigation results will be forwarded to the trade licensing office, which has the authority to suspend or revoke the business license for job mediation.
